In response to mounting legal challenges, the Federal Trade Commission (FTC) has officially vacated its 2024 rule that would have banned most post-employment noncompete agreements nationwide, choosing instead to pursue enforcement on a case-by-case basis.

For the veterinary sector, the decision is especially significant. Many in the veterinary space had voiced concerns that noncompetes restricted mobility, limited earning potential, and even forced relocations. In fact, former FTC Chair Lina Khan noted that veterinarians were among the most frequent responders during the rule-making process, sharing firsthand accounts of the hardships imposed by restrictive employment clauses.

With the FTC’s categorical ban off the table, regulation of noncompetes now largely returns to state oversight. Meanwhile, the FTC is soliciting public input to better understand the prevalence, enforcement, and competitive impact of noncompetes.

Veterinary industry revenue was up 1.4% year over year last week, a decline from the previous week’s 3.0%. Year-over-year visits also dropped from -1.3% to -2.5%.

Year-over-year parasiticide purchases continued to decline last week. Heartworm was -9.1%, and flea/tick was -5.1%, changes from -6.0% and -1.8% respectively the week prior. Service revenue was 2.7%, and product revenue was -2.5%, drops from the previous week’s respective 4.0% and -0.1%.

Last week, Maine saw the highest year-over-year revenue growth at 6.9%, while Oregon and Connecticut tied at a distant second place, each coming in at 4.9%. Oregon was once again the only state to see positive growth in year-over-year visits at 0.2%, with the runner-up being Minnesota at -1.3%.
