Earlier in December, the U.S. Department of Justice filed a statement of interest in a private lawsuit by Lincoln Memorial University (LMU) against standards and procedures used by the American Veterinary Medical Association (AVMA).

In the lawsuit, LMU alleges that the AVMA’s accreditation standards prevent new veterinary colleges from opening and unreasonably raise the cost of veterinary education. The AVMA has pushed back and filed a motion to dismiss these claims.

The DOJ has not taken a side in the lawsuit. They have expressed concern about professional accreditors not complying with antitrust laws and protecting competition when reviewing established accreditation laws.

Deputy Assistant Attorney General Dina Kallay of the Justice Department’s Antitrust Division says, “The Justice Department is committed to supporting pet owners, livestock farmers, and aspiring veterinarians by ensuring that accreditation standards and procedures do not unnecessarily restrict competition in veterinary education and services. Free markets succeed when there is robust competition unhindered by unnecessary restrictions. Veterinarian services are no exception to this rule.”

Veterinary industry revenue continued to fall into the negative last week, declining from -0.5% to -1.5% year over year. However, year-over-year visits increased slightly, from -6.4% to -5.6%.

Year-over-year parasiticide purchases declined last week, with heartworm at -15.5% and flea/tick at -12.1%, changes from -11.8% and -10.3% respectively prior to the Christmas holiday. Service revenue took a slight dip from 0.9% the week before Christmas to -0.1% last week, and product revenue dropped from -5.9% to -6.3% during the same period.

Connecticut and Maine continued to experience the highest year-over-year revenue growth at 6.6% and 6.4% respectively. Oregon is the only state to see slight growth in year-over-year visits at 0.1%.
